1. Eligibility

You must be at least 13 years old to use FunStream. If you are under 18, you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf. We reserve the right to terminate accounts that do not meet this requirement.

2. Account Registration

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the confidentiality of your login credentials.
• You are responsible for all activity that occurs under your account.
• You must not create multiple accounts for deceptive or abusive purposes.
• We reserve the right to suspend or terminate accounts that violate these Terms.

3. Acceptable Use

You agree NOT to:

• Post, send, or share content that is unlawful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable.
• Impersonate any person or entity, or falsely represent your affiliation.
• Harass, bully, intimidate, or threaten other users.
• Send spam, unsolicited messages, or commercial advertisements.
• Upload malware, viruses, or any harmful code.
• Attempt to gain unauthorised access to other users' accounts or our systems.
• Use the App for any illegal activity or to facilitate illegal transactions.
• Exploit, harm, or attempt to exploit or harm minors in any way.
• Collect or harvest personal data of other users without their consent.
• Circumvent or interfere with security features of the App.

4. User Content

• You retain ownership of content you post (“User Content”).
• By posting User Content, you grant FunStream a non-exclusive, worldwide, royalty-free licence to use, display, reproduce, and distribute your content within the App for the purpose of operating the service.
• Chat messages are automatically deleted after 24 hours unless marked as permanent (e.g., challenge announcements).
• We do not guarantee the storage or preservation of User Content.
• We reserve the right to remove any content that violates these Terms.

5. Community Moderation

• Messages that receive reports from 3 or more unique users may be automatically hidden.
• Users who receive reports from 5 or more unique reporters may be temporarily muted for up to 24 hours.
• We reserve the right to permanently ban users who repeatedly violate community standards.
• Moderation decisions are made to maintain a safe environment and are at our sole discretion.

6. Challenges

• Users may create and participate in challenges within the App.
• Challenge participation is voluntary.
• FunStream is not responsible for any disputes arising between participants.
• We reserve the right to remove challenges that violate these Terms.

7. Push Notifications

• By using the App, you may receive push notifications for new messages, mentions, and announcements.
• You can disable notifications at any time through your device settings.

8. Intellectual Property

• The App, its design, features, and original content are owned by FunStream and are protected by copyright, trademark, and other intellectual property laws.
• You may not copy, modify, distribute, or reverse-engineer any part of the App without our prior written consent.

9. Third-Party Services

• The App uses third-party services including Firebase (Google), for authentication, data storage, and messaging.
• Your use of these services is subject to their respective terms and privacy policies.
• We are not responsible for the practices of third-party service providers.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The App will be uninterrupted, error-free, or secure.
• Any defects will be corrected.
• The App is free of viruses or harmful components.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FUNSTREAM AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.

Our total liability for any claim arising under these Terms shall not exceed the amount you have paid to us in the 12 months preceding the claim, or GBP 100, whichever is greater.

12. Indemnification

You agree to indemnify, defend, and hold harmless FunStream and its affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the App, your User Content, or your violation of these Terms.

13. Termination

• You may delete your account at any time.
• We may suspend or terminate your account at any time, with or without cause and with or without notice.
• Upon termination, your right to use the App ceases immediately.
• Provisions that by their nature should survive termination shall survive (including Sections 10, 11, 12, and 14).

14. Governing Law and Dispute Resolution

• These Terms are governed by and construed in accordance with the laws of England and Wales.
• For users in the United States, any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law.
• For users in the United Kingdom and European Economic Area, nothing in these Terms affects your statutory rights as a consumer.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes through the App or by other means. Your continued use of the App after changes constitutes acceptance of the updated Terms.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
